Welcome to Somnara Mind (hereinafter referred to as "we," "us," "our," or "Somnara Mind"). This User Agreement (hereinafter referred to as "this Agreement") is a legally binding agreement between you and us that sets out the terms and conditions governing your use of the Service.
The Service is a generative AI product. By using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to any part of this Agreement, please stop using the Service immediately.
This Agreement should be read together with the Somnara Mind Privacy Policy. The Privacy Policy explains in detail how we process your personal information and forms an integral part of this Agreement.
1. Description of the Service
Somnara Mind provides artificial intelligence-based content generation services, including but not limited to text, image, or other forms of generation features (as actually offered). We may update, modify, suspend, or discontinue any or all features of the Service from time to time without prior notice (except where required by law).
You understand and agree that AI-generated content is inherently uncertain and may be inaccurate, incomplete, biased, hallucinatory, or otherwise erroneous. Content generated by the Service does not constitute professional advice (including but not limited to legal, medical, financial, or investment advice). You are solely responsible for evaluating and assuming all risks associated with its use.
2. Account Registration and Management
2.1 You may need to register an account to access all or part of the features. When registering, you must provide true, accurate, and complete information and keep it updated in a timely manner.
2.2 You are solely responsible for maintaining the confidentiality of your account and for all activities that occur under your account. If you become aware of any unauthorized use, please notify us immediately at [email protected].
2.3 You must be at least 13 years of age (or the higher minimum age required by the laws of your jurisdiction) to use the Service. If you are under the applicable age, you may only use the Service with the consent and supervision of a parent or legal guardian.
2.4 We reserve the right to refuse registration, or to suspend or terminate accounts, in reasonable circumstances, particularly if you violate this Agreement.
3. Acceptable Use and Prohibited Conduct
You agree to use the Service only for lawful and legitimate purposes and in compliance with all applicable laws. You must not:
- Generate, upload, transmit, or attempt to generate any content that is illegal, harmful, threatening, harassing, defamatory, obscene, hateful, discriminatory, violent, pornographic, terrorism-related, or otherwise inappropriate;
- Infringe any third party's intellectual property rights, privacy rights, publicity rights, or other legal rights;
- Generate false information or deepfake content for the purpose of deception, fraud, or misleading others;
- Attempt to reverse-engineer, hack, interfere with, overload, or otherwise compromise the security or stability of the Service;
- Use automated tools (such as bots or scrapers) to access the Service beyond normal usage (except for API use that we expressly permit);
- Use the Service to train, develop, or improve AI models that compete with us (unless you have obtained our prior written permission);
- Circumvent any content filtering, security, or usage restriction mechanisms;
- Engage in any other conduct that we reasonably consider improper or harmful.
We reserve the right to monitor, review, remove content, and take enforcement actions (including suspending or terminating accounts), but we have no obligation to proactively review all user content.
4. Intellectual Property and Content Ownership
4.1 Your Input Content: You retain all rights in the prompts, uploaded files, and other input content you submit. You grant us a worldwide, non-exclusive, royalty-free license to use, store, and process such content solely for the purposes of providing, maintaining, and improving the Service and performing this Agreement.
4.2 AI-Generated Outputs: Subject to your compliance with this Agreement, we grant you the right to use the generated outputs. You may use the generated content in accordance with applicable law and this Agreement. However, please note that:
- Generated content may be similar or identical to outputs generated for other users;
- We do not guarantee the originality, accuracy, or non-infringement of generated content;
- You are solely responsible for your use and subsequent distribution of the generated content.
4.3 Our Intellectual Property: The Service itself, including the software, models, interfaces, trademarks, designs, documentation, and all related rights, are owned by us or our licensors. You may not copy, modify, distribute, or otherwise exploit these materials without our prior written permission.

5. Fees and Payment (if applicable)
Certain features may be offered on a paid basis. Specific prices, billing methods, and subscription terms will be as displayed in the Service interface. You agree to pay all applicable fees in a timely manner. Unless otherwise required by law or expressly stated by us, fees already paid are generally non-refundable.
We reserve the right to adjust prices at any time. Material changes will be notified in advance.
6. Disclaimers
To the maximum extent permitted by law:
- The Service is provided on an "as is" and "as available" basis. We make no express or implied warranties of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted operation.
- We do not warrant the accuracy, completeness, timeliness, or suitability of AI-generated content. You should independently verify any important information.
- We shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from the use of or inability to use the Service (including but not limited to data loss, loss of profits, or business interruption).
7. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability to you arising from or related to your use of the Service shall not exceed the total amount of fees you paid to us in the twelve (12) months preceding the claim (or zero if no fees were paid). Some jurisdictions do not allow limitations of liability; in such cases, this limitation applies to the fullest extent permitted by law.
8. Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates, employees, and agents from and against any claims, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of this Agreement, your misuse of the Service, or your content infringing any third-party rights.
9. Termination
9.1 You may stop using the Service and delete your account at any time.
9.2 We may suspend or terminate your access at any time if you violate this Agreement or for other reasonable reasons (including service adjustments or legal requirements), and we may delete related content.
9.3 Upon termination, provisions of this Agreement that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) shall continue in effect.
10. Privacy
We process your personal information in accordance with the Somnara Mind Privacy Policy. By using the Service, you agree to that Privacy Policy.
11. Changes to this Agreement
We may modify this Agreement from time to time. Material changes will be notified through a prominent notice on our website, by email, or by other appropriate means, and the "Last Updated" date will be revised. Continued use of the Service after such changes constitutes acceptance of the modified Agreement. If you do not agree to the changes, please stop using the Service.
12. Governing Law and Dispute Resolution
This Agreement shall be governed by the applicable laws (determined by reference to your location and the jurisdiction of our operating entity). Any dispute arising out of or relating to this Agreement shall first be resolved through friendly consultation. If consultation fails, the dispute shall be submitted to a court of competent jurisdiction or resolved in accordance with any alternative dispute resolution method we designate.
13. Miscellaneous
- This Agreement constitutes the entire agreement between the parties concerning the Service and supersedes all prior oral or written agreements relating thereto.
- If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Our failure to exercise or enforce any right under this Agreement shall not constitute a waiver of such right.
- You may not assign your rights or obligations under this Agreement; we may assign ours.
